The Tenth Amendment

Reserved Powers

http://caselaw.lp.findlaw.com/data/constitution/amendment10/

Constitutional Connection

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." (http://caselaw.lp.findlaw.com/data/constitution/amendment10/)

Analysis of the Connection

Based on my understanding, the tenth amendment is the right to establish laws that the government ahsn't alteady astalitblished in your own city, as long as those rules don't conflict with the ones that have already been made. This meaning it gives little power to the people if ther is room.

This picture is some what of a conntradictory of what I am explaining. In this picture the government is telling people that they do have all the power, which sort of angers the citizen of the united states.

The Fifth Amendment

Rights of a Person

http://caselaw.lp.findlaw.com/data/constitution/amendment05/

Constitutional Connection

"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."  (http://caselaw.lp.findlaw.com/data/constitution/amendment05/)

Analysis of the Connection

According to my understanding, this law prevents people in the United States from being charged with tedious crimes such as J-Walking. For those who don't know, J-Walking is when you cross the street without obeying the traffic signs or crossing in the middle of the street.

Double jeopardy was a movie that clearly explains how double jeopardy works. These two couple were married, but the husband became bored with his marriage. He didn't want to tell his mate, so he took her on a cruise and faked his death. Since they were the only two on the cruise and the husband couldn't be fund, the wife did time for the "murder". In jail she learned that she in the state she was in, she couldn't be charged with the same crime twice. When she was released on parole, she learned that her husband was still alive. She then tracked him down and killed revenge, but thanks to double jeopardy, she couldn't be charged with the crime.

This picture illustrates a lawyer in a criminal over a petty case, but since the criminal pleaded the fifth the lawyer had no way to show off the evidence that he had because there was no argument. Still, the lawyer assumed that the defendants silence was proof of how guilty he was.

The Fourth Amendment

Search Warrants

http://en.wikipedia.org/wiki/Search_warrant

Constitutional Connection

The fourth amendment is the bill of right that protects the people of the united states from being searched and sent sent through unnecessary procedures without reasoning. This law requires the authoritative figure to possess some type of search warrant or arrest warrant which is required to be appointed by a court judge. The only way that a judge is allowed to give out search warrants is if there is probable cause which needs to be determined by the judge themselves.

Analysis of the Connection

The fourth amendment, in my opinion is one of the greatest laws ever created because it determines whether or not the authoritative figure is doing his or her job. If it is late at night and your driving home safely, meaning that you have on a seat belt, you're not under the influence and your doing the speed limit, the cops have no reason to stop you. Now if that cop does stop you, you have the right to ask them what is the reason for which they are stopping you. If the cop finds something you shouldn't have in your vehicle and decides to take you in, your argument in court would be that the officer had no reason to stop you and for all you know the cop couldd just be trying to make their selves look good by pulling over a random person and planting things in their vehicles.

This picture show a team of police officers searching a house for evidence, but in order for them to search the  house they had to get a search warrant from the court judge. The picture then goes on to become humorous by saying the proof is in the pudding, literally showing the proof they were looking for in a bowl of pudding.

Freedom of Speech- Ground Zero

"TIME Poll: Majority Oppose Mosque, Many Distrust Muslims" 8/19/2010

http://www.time.com/time/nation/article/0,8599,2011799,00.html

Constitutional Connection

Freedom of speech is the freedom to speak without having to be an authoratative figure and to be able to speak with out limits to what you can speak on. In practice, the right to freedom of speech is not given in any country and the right is commonly falls short as to what you speak on, such as on slandering untru alligations against others. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law.
Analysis of the Connection

The freedom of speech is a right that every one exercises without caution. When people exercise their right to the freedom of speech it is usually to object with an idea or sometimes just to voice an opinion. Even though people have the right to the freedom of speech, they still need to careful about what they say. For example, if you were speaking to one of your elders that made you upset, you wouldn't curse them out because of the respect that you are suppose to show to them.

The article talk about how a poll was taking and how 61 % of the nation is opposed to building of the mosque. In m7y opinion this exhibits freedom of speech because the people have the right to say whether or not they want the mosque builded, but just becuase they say they don't doesn' t mean that it will stop it from being built. In some cases, the right to freedom of speech together has help overturn something that it is unwanted in the country, but it is very seldom in which something like that happens.

Freedom To Assemble

“Obama supports “the right” for ground zero mosque.” August 14, 2010

http://news.yahoo.com/s/ap/20100814/ap_on_go_pr_wh/us_ground_zero_mosque_obama

Constitutional Connection

Freedom of assembly is part of the first constitution and is the right to come together and share opinions, support ideas and fight for their beliefs. When exercising the freedom to assemble, citizens have the right to assemble in public places or in official organizations. Commonly, when people exercise their right to assemble, it's usually to protest something. In the U.S. Constitution it is intended to mean both the freedom to assemble and to join associations.

Analysis of the Connection

The Freedom of Assembly, which is the first Bill of Right, is a right which allows people of any and every assortment, as far as race and gender, to come together and collaborate on issues they may be concerned about. Commonly, people exercise this right of freedom to assemble when they are protesting or boycotting an issue that they feel strongly about. The most common issues are because of work conditions, employment cuts, wages, education, and sometimes laws.

In an interview with the president, news reporter Paul Jelinek, managed to get the president’s point of view on the issue at ground zero. President Barack Obama believes that the Muslims have the right to build the mosque according to the first amendment. President Barack Obama also stated that by building the mosque, the Muslims are exercising their right to freedom of religion.

I agree with President Obama. I think that the Muslims have the right to build the mosque because it is their given right as an American citizen. In the article, they said that President Obama never mentioned whether or not he thought that building the mosque was a good idea. I believe building the mosque is a good idea because it proves that all Muslims are bad. If Muslims can be trusted to associate near ground zero without posing as a threat, there shouldn't be a problem.

The Right To Bear Arms

“Gun Ban Ban.” 8/20/10

http://www.cagle.com/news/GunBanBan/3.asp

Constitutional Connection
The Second Amendment to the United States Constitution is the part of the United States Bill of Rights that protects the right to keep and conceal weapons. It was adopted on December 15, 1791. The Court ruled that the Second Amendment protects an individuals right to possess a firearm unconnected with the U.S army or any other governmental program that allows them to carry weapons.
Analysis of the Connection
The founding fathers made the second amendment so that anyone can have the rights to carry firearms, even if they aren’t an authoritative figure. They came to the conclusion that carrying firearms helps protect an individual under the law. The legal action is called self defense. The right to have arms in English history is believed to have been regarded as a long established natural right.

Political Cartoon on Gun Rights

In this political cartoon, a news reporter interviews a random pedestrian and asks him for his opinion about the Supreme Court’s ruling on the hand gun bill. The pedestrian responds by saying that he feels as if there is a higher risk of him becoming a victim to gun violence. Hen the reporter asks what he intends to do in order to not become a victim of gun violence, he replies, “Well, I’m certainly going to stop breaking into people’s houses….”

I agree with the statement in the cartoon that says that passing the handgun bill will result in higher risks of people falling victim to gun violence. This statement, in my opinion, is true because more people will now start to carry guns because they know it’s allowed and it may make them feel safer. Now that the crime rate in Chicago is so high, there might be frequent reports of suspects getting harmed by guns due to self-defense.
